Divorce
Contested Divorces
Contested Divorces The divorce process can be a complicated task. You may sue for divorce thinking that the proceeding will be uncontested, but thereafter discover that your spouse has decided to contest the divorce which means, he has decided to fight the case. Although divorces may be emotionally contentious, most divorces do not end up contested.
In every divorce there are many issues at stake, including:
- How to divide marital property
- Custody of the children
- How much spousal and child support should be paid and by which party
Usually both parties negotiate and settle issues such as division of property, spousal support, and child custody. There are cases where both parties reach an agreement by mediation, with a trained mediator who intervenes and tries to help both parties to reach an agreement. The parties then present their negotiated or mediated agreement to a judge.
If both parties are unable to agree about issues regarding property, support, and child custody, they may ask the court to decide one or more of those issues.
Contested divorces often involve very complex issues and technical legal procedures in court. While an uncontested divorce can often be faster and less expensive, a contested divorce, due to its complexity, can be sometimes extremely difficult and painful for both parties and their children, especially if there are financial and personal issues that cannot be agreed upon between both parties. Ross & Asmar will guide you through this difficult process and time in your life to ensure that you get the best outcome.
Uncontested Divorces
An uncontested divorce is appropriate where the spouses have agreed on issues related to their divorce, including property division, child custody and support and spousal maintenance without the intervention of a judge. An uncontested divorce is the most affordable and timely way to dissolve a marriage. Ross & Asmar has handled many uncontested divorces and will see to it that your uncontested divorce will be handled in the most expeditious and cost-effective manner.
